Top of the Queue: What Critical Infrastructure Designation Means for Environmental Performance
On 24 July 2026, the Government designated the first nine projects and programmes as critical infrastructure under the Critical Infrastructure Act 2026. The designations, approved on the recommendation of Minister for Public Expenditure, Infrastructure, Public Service Reform and Digitalisation Jack Chambers TD, place these projects at the top of the queue for processing and decision-making by every public body involved in their delivery.
The first tranche spans three sectors. In transport: MetroLink, the Cork Area Commuter Rail Programme and the Galway City Ring Road. In water: the Water Supply Project for the Eastern and Midlands Region, the Greater Dublin Drainage Project, and the Limerick (Bunlicky) Wastewater Treatment Plant Upgrade and Bioresource Centre. In energy: the North South 400 kV Interconnector, the Moneypoint 400 kV Series Capacitor Project and the Letterkenny 110 kV Redevelopment Project. Further designation orders are expected at regular intervals throughout the year.
What designation actually does
Designation does not remove any consent, licence or permission from the approval pathway. A typical capital project still requires dozens of authorisations — planning permission from An Coimisiún Pleanála, environmental authorisation from the EPA where relevant, maritime area consents from MARA, sectoral licences, and certification of planning conditions by local authorities.
What the Act changes is the obligation on the bodies granting them. Public bodies must prioritise designated projects, take steps to reduce the time required for each authorisation, run their processes in parallel with other bodies wherever possible, and allocate the administrative and technical resources needed to do so. The Department is explicit that this accelerates decision-making “without dictating specific decisions” — the tests remain the tests; they are simply applied faster and concurrently.
Why acceleration raises the bar on environmental evidence
For delivery teams, this is the detail that matters. When consenting processes run in parallel rather than in sequence, the environmental evidence supporting each application has to be robust from the outset — there is less slack in the programme to fill data gaps discovered late. Baseline noise and air quality surveys, carried out well before mobilisation, become programme-critical rather than a box to tick.
The same logic applies once works begin. Projects moved to the front of the queue will draw public attention in proportion to the speed of their delivery. Tunnelling through a capital city, upgrading wastewater capacity beside existing communities, building overhead lines through rural townlands — each of these generates noise, dust and vibration at the boundary between a national priority and somebody’s home. Continuous, transparent environmental monitoring is what allows a project team to demonstrate — with data rather than assurances — that accelerated delivery and responsible delivery are the same thing.
That evidence base does practical work throughout the project lifecycle: discharging planning conditions, responding to complaints with measured fact rather than estimation, and giving regulators, elected representatives and residents a shared, verifiable record of site performance.
